Many people still view marital property agreements as taboo, yet this document is not about a lack of trust but about responsible, long-term thinking. My goal as an attorney is to help couples create clear and transparent frameworks from the outset, preventing protracted and undignified property disputes later on.
Under Hungarian law the default rule is community of property: everything acquired during the partnership is shared. However, this is not fair or practical in every situation. A property agreement allows the parties to create their own rules, deviating from the statutory default.
A property agreement is especially recommended when:
- one party enters the relationship with significant separate assets (property, savings);
- one spouse is an entrepreneur and wishes to separate business risks from the family estate;
- the parties wish to protect assets received through gifts or inheritance;
- they wish to safeguard the inheritance interests of children from a previous marriage.

Cohabitation property agreement
It is important to know that entirely different rules apply to cohabitants than to married couples: no community of property arises automatically. A cohabitation agreement, however, can prevent lengthy evidentiary proceedings about contribution ratios after a break-up.
